Challenging a Voluntary Acknowledgement or Denial of Parentage

What Does it Mean?

A signed Voluntary Acknowledgement of Paternity (VAP) or denial of parentage can only be challenged within TWO (2) YEARS of its being signed. If the VAP or denial is successfully challenged, the originally signed documents will become null and void

Things You Should Know

VAPs and Denials of Parentages can only be challenged for one of the following reasons:

  • a person was pressured into signing, or was otherwise forced to sign the VAP or denial against their will
  • the VAP or denial of parentage was fraudulently signed; OR
  • the VAP or denial was signed while a person did NOT know the relevant facts of the situation, so long as it has been TWO (2) YEARS since one gained knowledge of these facts
