Non-Custodial Parent

What Does it Mean?

A non-custodial parent is a child's legal parent, but does NOT have legal custody of the child.

Things You Should Know

The legal parent with custody of a child is the custodial parent.

Non-custodial parents have the right to ask for custody of their child. To do so, they must file a motion to change (modify) their custody order. Similarly, they also have the right ask for visitation (parenting time) with their child.
