What Does it Mean?

presumed parent is a person that becomes the legal parent of a child because they are married to the child's legal parent.

Things You Should Know

Presumed parents are parents that have had their parentage legally established. You can become a child's presumed parent only if:

  • you are married to or in a civil union with the child's biological mother at the time the child is born (unless there is a gestational surrogacy agreement); OR
  • the child is born within 300 days of you divorcing your spouse or dissolving you and your partner's civil union
