Terms and Conditions

Acceptable Terms

The Terms and Conditions of Use (“Terms and Conditions” or “Terms”) include any posted guidelines or rules applicable to particular content or Services and, as updated by SAEF Legal Aid from time to time, are collectively referred to as the "Terms and Conditions" and govern the use of the Site. You should carefully read the Terms and Conditions before using the Site. By using the Site, you: (a) agree to be bound by the Terms and Conditions; (b) represent and warrant that you are at least eighteen (18) years old; and, (c) represent and warrant that you have the legal authority to accept the Terms and Conditions. This is a legally binding agreement. If you do not agree to the Terms and Conditions, you are not authorized to use the Site. In the event of a conflict between these Terms and Conditions and any posted guidelines or rules applicable to particular content or Services, the posted guidelines or rules shall govern to the extent of such conflict.

Changes

We may change these Terms from time to time. The most recent version will replace and supersede all previous versions. You should return to this page from time to time to review the rules applicable to using our Site.

Compliance with Applicable Laws

Headings, paragraphs, blockquotes, figures, images, and figure captions can all be styled after a class is added to the rich text element using the "When inside of" nested selector system.

Our Service may contain links to third-party websites or services that are not owned or controlled by the us. We have no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party website or service. By linking to such sites, we do not agree with or endorse the content or owners of those sites.

You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such website or services.

Services Not Provided

SAEF Legal Aid is not a law firm and is not engaged in the practice of law. Use of our Site and Services does not create an attorney-client relationship. If you initiate contact with another organization, company or firm via SAEF Legal Aid and that results in an attorney-client relationship being formed at any time, including but not limited to during a consultation, SAEF Legal Aid has no involvement in that relationship nor in any agreements arising out of the relationship. SAEF Legal Aid does not accept any portion of an attorney’s fees.

Prohibited Behavior

You are responsible for all content that you upload, post, email, or otherwise transmit using the Site. Likewise, you are responsible for respecting SAEF Legal Aid’s and third parties’ rights with respect to content that appears on the Site and not to download, email, or otherwise transmit such content in violation of SAEF Legal Aid’s and third parties’ rights. You agree to use the Site solely to accommodate your own personal needs. You may not use or exploit any portion of the Site to provide any commercial services to third parties or offer any portion of the Site to any third party. You shall not use the Site or Services to:

  • Upload, post, email, or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright, or other intellectual property right, privacy right, or publicity right of any person or entity. By uploading, posting, emailing, or otherwise transmitting any content, you represent and warrant that you have all rights to take such action with respect to the content;
  • Upload, post, email, or otherwise transmit any content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, pornographic, sexually explicit, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise offensive;
  • Misrepresent your identity or impersonate another person or entity, including without limitation, a representative of SAEF Legal Aid or its officers, directors, employees, or agents, falsely represent or misrepresent your affiliation with another person or entity, or forge headers or otherwise manipulate identifiers that would disguise the origin of any content transmitted to or through the Site;
  • Upload, post, email, or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, including without limitation, initiation or perpetuation of any “Spam”, “Junk Mail”, chain letters, or any other potentially objectionable form of unsolicited communication;
  • Collect or store personal data with respect to third parties except as contemplated by the Terms and Conditions and then only for the express purpose of providing lawful communication that may reasonably be anticipated by such third parties;
  • Directly or indirectly, intentionally disrupt or interfere with the Site in any manner that may materially adversely affect SAEF Legal Aid or any third party;
  • Upload, post, email, or otherwise transmit any material that contains software viruses or any other code, files, or programs designed or known to disable, interrupt, or limit the functionality of any computer hardware, computer software, or telecommunications equipment or facilities; or,
  • Upload, post, email, or otherwise transmit without authorization any material that contains personal or private information concerning any third party person or entity, including without limitation, any phone numbers or addresses, credit/debit cards, calling cards, account numbers, social security numbers, passwords, or other similar information.

Copyright

The content on the Site is owned by SAEF Legal Aid and third parties and is protected by the United States Copyright Act of 1976, as amended, and the copyright laws of other countries. Certain materials are used by permission of their respective owners. The content of the Site may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without the prior written permission of SAEF Legal Aid. Modification or use of the content for any other purpose except as permitted under these Terms and Conditions is a violation of the rights of SAEF Legal Aid or third parties.

Copyright Infringement

If you are a copyright owner or an agent of a copyright owner, and you believe that any content on the website, mobile apps, or other online services infringes such copyright(s), then you may submit a notification pursuant to the Digital Millennium Copyright Act of 1998 (the “DMCA”) by providing our Designated Copyright Agent with the following information in writing:

  • a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • identification of the copyrighted work claimed to have been infringed;
  • identification of the material that is claimed to be infringing and information sufficient to permit us to locate the material;
  • contact information of the complainant, such as an address, telephone number, and, if available, an email address;
  • a statement that the complainant has a good faith belief that use of the material is not authorized; and
  • a statement that the information in the notification is accurate, and under penalty of perjury, that the complainant is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Disclaimer of Warranties

THE USE OF THE SITE IS SOLELY AT YOUR OWN RISK. THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. SAEF LEGAL AID EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND WITH RESPECT TO THE SITE (INCLUDING, WITHOUT LIMITATION, THE CONTENT AND/OR SERVICES OFFERED ON THE SITE) WHETHER EXPRESS OR IMPLIED INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SAEF LEGAL AID EXPRESSLY DISCLAIMS ANY RESPONSIBILITY FOR THE ACTIONS OF ANY USER WHO USES THE SITE. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. SAEF LEGAL AID MAKES NO WARRANTY THAT THE SITE WILL MEET YOUR REQUIREMENTS, OR WILL BE UNINTERRUPTED, TIMELY, SECURE, CURRENT, ACCURATE, COMPLETE, OR ERROR-FREE OR THAT THE RESULTS THAT MAY BE OBTAINED BY USE OF THE SITE WILL BE ACCURATE OR RELIABLE. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT SAEF LEGAL AID SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA LOSS, OR OTHER LOSSES (EVEN IF SAEF LEGAL AID HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM ANY MATTER RELATED TO YOUR USE OF THE SITE.

Arbitration

In case of any disputes between us that cannot be resolved through informal discussions, you agree to submit such disputes to a neutral arbitration organization appointed by the American Arbitration Association and in accordance with the Federal Arbitration Act. The arbitrator’s decision and award is final. You and we also both agree not to disclose the contents of the arbitrator’s decisions related to the arbitration to anyone (except as required by law or for the purposes of enforcement or appeal of the arbitration award).

Arbitration will cover all disputes and claims regarding these Terms, including tort claims, direct claims, or indirect claims. The arbitrator can issue rulings on any substantive or procedural issues arising in the dispute, including the scope of the dispute. This arbitration clause will continue to be valid even if these Terms are no longer valid for some reason.

If you have a claim or dispute, you must contact us first, so we can try to resolve the matter. You agree to give us 60 days to try to resolve the dispute before requesting arbitration. The arbitration of any dispute or claim will follow the relevant rules of the American Arbitration Association as modified by these Terms.

If you and we have to participate in arbitration of disputes between us, such arbitration shall take place in Chicago, Illinois. The arbitrator may not award relief in excess of or contrary to what these Terms provide, order consolidation or arbitration on a class-wide or representative basis, award punitive or consequential damages or any other damages aside from the prevailing party’s actual damages, or order injunctive or declaratory relief, except that the arbitrator may award on individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration section is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect.

There shall be no right or authority for any claims subject to this arbitration section to be arbitrated on a class action or consolidated basis or on bases involving claims brought in a purported representative capacity on behalf of the general public.

You must contact us within one year of the date of the event or facts giving rise to a dispute or you will have waived the right to pursue a claim based on such event or facts.

Miscellaneous

The Terms and Conditions constitute the entire agreement between you and SAEF Legal Aid relating to the Site. There is no agency, partnership, joint venture, employee-employer, or attorney-client relationship between any user and SAEF Legal Aid arising solely through the use of the Site. The Terms and Conditions are binding upon your successors, assigns, heirs, and executors. If any provision of the Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms and Conditions, which shall remain in full force and effect. The failure of SAEF Legal Aid to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or condition. Any claim or cause of action arising out of or related to the Site or the Terms and Conditions must be filed within one year after such claim or cause of action arose. The section titles of the Terms and Conditions are merely for convenience and will not have any effect on the substantive meaning of this Agreement.
